By North Carolina law, this office does not prepare or change any documents; we are record keepers only. We are able to provide forms for Satisfactions and Assumed Name, but we are not able to assist in the preparation of these or any other documents. If you have legal questions about documents, or require legal documents to be prepared, we recommend that you contact an attorney.
The Register of Deeds can record original documents which contain original signatures and proof of acknowledgment (notarization). By law all real estate documents recorded in the Register of Deeds office are open for public inspection.
Access to these public records is also available at the Register of Deeds office in the Public Record Search Room from 8:30 a.m. until 5:00 p.m.
RECORDING
Requirements
EFFECTIVE JULY 1, 2002; REVISED OCTOBER 1, 2011 AND REVISED OCTOBER 1, 2019 SIGNIFICANT CHANGES TO N.C.G.S. 161-14
These changes apply to instruments executed on or after July 1, 2002. To be recorded, they must meet all of the following requirements:
PAPER:
8 ½ X 11 inches OR 8 ½ X 14 inches
MINIMUM:
A blank margin of three (3) inches at the top of the first page
MARGINS:
A blank margin of at least one-half (½) inches on the remaining three sides of the first page and on all sides of all subsequent pages
TYPE:
- Typed or printed in black ink on white paper in legible font
- Font size of 9 point or larger
- Text on only one (1) side of the paper
- Color or Gray scale images are considered non-standard
- State type of instrument at the top of the first page
- Never use a highlighter over pertinent information
Non-standard:
Any document not meeting the above standards may be recorded for a fee of $25.00 in addition to the regular recording fee.
*Please note that our office does not have UPS or FEDEX mail return services, UNLESS prepaid envelopes are received when the documents are received by mail.*
E-RECORDING
Transylvania County Register of Deeds offers e-Recording – an option for recording documents electronically via the internet. The e-Recording service allows for submission, receiving and processing of documents in a more direct and timely manner. Companies may find that recording documents electronically can save time and resources.
Financial and legal companies, attorneys, surveyors etc. that would be interested in submitting electronically to Transylvania County Register of Deeds will need to contact one of our authorized e-Recording providers for more information. Below is a list of the current e-recording companies we are partnered with.

DEEDS OF TRUST AND SATISFACTIONS

Satisfactions
When a deed of trust or mortgage is paid in full, the bank or other party to whom the money was owed is responsible for recording the satisfaction and forwarding it to the borrowers within 30 days of payoff.

ASSUMED BUSINESS NAMES (DBA)
An Assumed Business Name Certificate or “doing business as’ (DBA) form, once recorded, notifies the public that you are doing business in any or all North Carolina counties under a particular name.
A Certificate of Assumed Name or “doing business as” (DBA) form can be recorded in our office by individuals or entities conducting business in Transylvania County, multiple counties or all 100 counties in North Carolina. A sole proprietorship, general partnership, limited partnership, LLC or corporation engaged in business in Transylvania County under a different assumed name might consider recording a DBA form at the Transylvania County Register of Deeds Office. In many cases, a financial institution will require this form be recorded in order to open a business account. Please consult a business advisor or an attorney if you have questions about whether recording this form is required for your business.

PLATS
Plat Recording Requirements
Acceptable sizes are ONLY 18” x 24” with at least 1/2'’ border on all sides.
Plats must be reproducible and be black ink on white paper or mylar.
The Register of Deeds checks for surveyor original seal and wet-ink signature and statements as required by G.S. 47-30.
Certain plats will need to be reviewed by the county (Planning department located on the second floor in Community Services building) or city review officer before recording.
